This program will discuss how attorneys can counsel their clients to seek registration for color marks and demonstrate acquired distinctiveness along with practical considerations to meet that goal. The program will also discuss recent TTAB decision where a color mark was denied registration and federal court cases showing the difficulty in enforcing color marks.
